Licensing Time Frames for Zoning Permit Applications

10 PURPOSE: To establish time frames for Zoning Permits, including Home Occupations, Travel Trailer (including RVs and motor homes), Limited Animal, and Accessory Residence Administrative Permits

11. POLICY: The Development Services Department staff will comply with the ordinance sections regarding permits and this policy.

12. PROCEDURE: Zoning Permits

Zoning Permit Applications:

  1. Application packages for zoning permits shall include all items on the appropriate checklist, including a completed worksheet, an accurate plot plan, and approval of sewage or septic system as appropriate. Checklists will be displayed on the Department’s www.mohavecounty.us.
  2. Application packages shall be submitted at the Kingman, Bullhead or Beaver Dam offices of Development Services.
  3. Upon receipt, each application shall be entered into the ACCELA Automation program and given an appropriate workflow.
  4. Each application package shall be reviewed for Administrative Completeness and Substantive Compliance.
  5. Applications that comply with the checklist requirements, the requirements in the Zoning Ordinance, the Environmental Health Department, and all other pertinent Departments will be approved and issued upon payment of appropriate fees.

Time Frames:

  1. Review process for zoning permits will include an Administrative Completeness Review and a Substantive Review. The review time frame for the combination of these reviews is 30 working days.
  2. Upon submission of the application package, the Administrative Completeness Review period begins. The purpose of this period is to ensure the package contains the information required to conduct a review and it is complete. All items noted as pre-requisites in the appropriate checklist, the application worksheet, the plot plan, and any septic system approval must be included in an application for zoning permits. The Administrative Review time frame is 10 working days. If an application is incomplete, it will be returned to the applicant for completion; the time frame period will suspend while the applicant is completing it. If the application is missing information that can be submitted as an addendum to the application, the Department may, at their discretion, hold onto the deficient application for up to 15 days so the information can be submitted. Applications held 15 day without submission of the additional information will be returned. Upon the submission of each subsequent submittal, the time frame will commence from the point it suspended with the last correction notice. If the application remains incomplete upon the suspending of the Administrative Review time frame, it will be denied.
  3. Upon the successful completion of the Administrative Completeness Review, the Substantive Review process commences. During this period the Department reviews the application to ensure that it complies with the County’s adopted ordinances, standards and codes. Each reviewing department may request additional information once during the review process, but additional information may create need for further information or comments. Each request for additional information and each comment noting deficiencies that must be corrected will stay the time frame while the application is in the applicant’s possession. Upon the submission of each subsequent submittal, the time frame will commence from the point it suspended with the last correction notice. The time frame for Substantive Review is 20 working days. If the application remains non-compliant upon the ending of the Substantive Review time frame, it will be denied.
  4. Per §11-1605.H, the applicant and Mohave County may extend the substantive review time frame and the overall time frame by written or electronic agreement. Extensions may not exceed 25% of the overall time frame.

Requests for Information

  1. During the Administrative Review, the Department shall make a comprehensive listing of deficiencies, if any. Subsequent notices of deficiencies shall be based on the applicant’s submission of the missing or errant information. All correction and deficiency notices will be in writing and/or electronically transmitted.
  2. During the Substantive Review, the Department may make one request for additional information. To facilitate approval of applications, the applicant and the County may agree, in writing or electronically, to allow the submission of additional information beyond the first request. All correction and deficiency notices will be in writing and/or electronically transmitted.

Denials/Appeals

Justification for a denial will be given to the applicant in writing. The explanation will include references to the statutes, ordinances, regulations, substantive policy statements, or delegation agreements from outside agencies on which the denial is based (§11-1605.I.1). Justifications for denial will include an explanation of the applicant’s right to appeal the denial, that the appeal must be submitted to the identified person within fifteen (15) working days of the denial, and the name and telephone number of a County contact person who can answer questions regarding the appeal process (§11-1605.I.2).

13. RISK

Failure of the Development Services Department staff to comply with this procedure would be in conflict with State Statute and the Board of Supervisors adopted ordinances for Zoning and Building Permits. Failure to comply with licensing time frames could also result in the County: 1) being required to accept an incomplete application; 2) refunding to the applicant all fees charged for reviewing and acting on the application; 3) excuse payment of any fees that have not yet been paid; and 4) continue to process application.
